Please read these Terms and Conditions (“Agreement”, “Terms and Conditions”) carefully before using Virtual Graduate website or any sub-site (“the website”, “the site”) operated by Virtual Graduate (“us”, “we”, or “our”). This Agreement sets forth the legally binding terms and conditions for your use of the website.
By accessing or using the website in any manner, including, but not limited to, visiting or browsing the website or contributing content or other materials to the website, you agree to be bound by this terms and conditions.
The website and its original content, features and functionality are owned by Virtual Graduate and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.
We may terminate your access to the website, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature shall survive termination, including, without limitation, ownership provisions, warranty, disclaimers, indemnity and limitations of liability.
By clicking the ‘Accept’ button you agree to these terms and conditions. By completing and submitting the electronic order form (or proceeding through the ‘checkout process’) & or by speaking to a Virtual Graduate representative you are making an offer to purchase goods which, if accepted by us, will result in a binding contract. Neither submitting an electronic order form nor completing the checkout process constitutes our acceptance of your order.
This Agreement (and any further rules, polices, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of United Kingdom, without giving effect to any principles of conflicts of law.
We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms and Conditions.
Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the Site or discontinue any use of the Site immediately.
We will provide you with access to your course once you have enrolled and completed payment. You will need to log on using your user name and password to use the course.
Your right to cancel
Virtual Graduate website:
If for any reason you are not satisfied with your course you have purchased, you are entitled to a full refund, providing that the course has not been accessed. To request a refund please contact firstname.lastname@example.org within 14 days of purchase. You agree that you will lose your above right to cancel the course and get a refund of any course fee you have paid if you have started using the course.
If you are entitled to a refund, this will be paid to you within 7 days of the date of your cancellation. Any access to course materials will be suspended immediately.
Third party website:
If you purchased your course through a third party website (ie Groupon), please contact the provider directly to request your refund.
Access to website, server and course improvement
As we are continually improving and upgrading our courses and security there may be an occasion where you will be unable to access your course. Please be assured that this time will be kept to a minimum and is in the interest of our learners. We strive to supply our students with the latest, up to date courses that are in demand today.
Once you have completed your course, you will be able to download your certificate immediately.
Payment can be made by any of the options advertised on our website. Payment shall be due before commencement of service, unless we have agreed otherwise. If payment fails your order will be cancelled.
Our secure server software encrypts all your payment card details. The process scrambles all the information, allowing no unauthorised third party to intercept the data. Your browser will confirm that you are shopping in a secure environment by showing either a locked padlock icon or an image of a padlock next to the payment details in the relevant area of the Website.
To ensure that your credit, debit or charge card is not being used without your consent, we will validate name, address and other personal information supplied by you during the order process against appropriate third party databases.
If you are not satisfied with any aspect of the services, please email email@example.com. Any such complaint should be submitted within seven days of the problem first arising. We will acknowledge receipt of your complaint within a maximum of five working days and will aim to resolve the complaint within fourteen days.
Accuracy of marketing materials
Every reasonable attempt has been made to describe Virtual Graduateduate courses and any other services mentioned. We believe that all the statements on our website and other marketing materials are correct at the time they are made.
We cannot be held responsible for any changes that become known or happen after printed materials are produced. Nor can we accept liability for happenings outside our control. We will undertake to inform you of any material changes to your course before commencement of the course providing there is sufficient time and we are able to contact you.
For the purposes of the Data Protection Act, Virtual Graduate is a data controller. We will store the personal data that you give us, and will use it for the purpose of processing your application and the provision of the services in this agreement. This includes disclosing your personal data, such as your name and contact details, to our tutors. Any calls or emails that you send to Virtual Graduate may also be recorded and stored both for training purposes, and for future reference should any issue arise.
All data is kept in accordance with the Data Protection Act 1998. You have a right to ask for a copy of your information and correct any inaccuracies in your data. If you believe that any of your personal details that we process are inaccurate or incorrect, please contact us immediately to firstname.lastname@example.org.
By agreeing to these Terms and Conditions, you acknowledge and agree that we may transfer, store and process your personal data and sensitive personal data as set out above.
Please note, our Data Protection Policy may change periodically to reflect developments in the law. You can request a copy of our current policy at any time to understand how we gather, use and store data.
Interpretation in a dispute
If any wording in this agreement for any reason is held by a Court to be unfair, illegal or unreasonable, it will not bind you. The Court can remove that wording from the agreement, and the rest of the agreement will still continue to bind us and you.
This agreement and any claim or dispute arising from or related to this agreement, will be governed by, and shall be construed in accordance with, English law and the Courts of England and Wales shall have exclusive jurisdiction over any claim arising out of it.
